Rooftop Pool Day Pass ā Release of Liability, Waiver of Claims, Assumption of Risk & Indemnity Agreement
The Mary Anne Boutique Hotel, Charlotte Amalie Historic District, St. Thomas, USVI ("the Hotel"). By checking the box above and submitting, I agree to the following on behalf of myself and any minor(s) in my party.
1. Assumption of Risk. Use of the rooftop pool, sun deck, game lawn and related Facilities involves inherent risks including drowning or near-drowning, slipping on wet surfaces, diving or jumping injuries, sun and heat exposure, alcohol consumption, and cuts or falls ā which can result in serious injury, permanent disability, or death. I voluntarily assume all such risks, whether known or unknown.
2. Release of Liability & Waiver of Claims. In consideration for use of the Facilities, I, for myself and my heirs and assigns, release, waive, discharge, and covenant not to sue the Hotel, its owners, operators, management company, employees, agents, and contractors (the "Released Parties") from any and all liability, claims, or causes of action arising from any loss, damage, illness, or injury (including death) sustained by me or my property, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE, to the fullest extent permitted by law.
3. No Lifeguard on Duty. The rooftop pool may not be staffed by a lifeguard; swimming and pool use are entirely at my own risk. I will supervise myself and any minors in my party at all times and will not leave children unattended near the pool.
4. Health, Alcohol & Fitness. I confirm I am physically fit to use the Facilities and unaware of any condition making participation unsafe. I am solely responsible for my own alcohol consumption and conduct, and the Hotel is not responsible for the effects of alcohol on me or my party.
5. Guest Conduct & Property. Day Pass access is valid only during posted hours (currently 10:00 AM ā 5:00 PM) and is subject to availability and hotel occupancy. I am responsible for my belongings; the Hotel is not liable for lost, stolen, or damaged property. I will follow all posted rules and staff instructions, and understand the Hotel may remove any guest for unsafe or disruptive conduct without refund. I am responsible for any damage I or my party cause to Hotel property.
6. Medical Treatment Authorization. In an emergency involving me or a minor in my care, I authorize Hotel staff to contact emergency medical services and take reasonable action to obtain care, and I agree to be financially responsible for resulting medical costs.
7. Photo & Video Release. I grant the Hotel permission to photograph or video me and my party and use such images for promotional or marketing purposes, unless I notify the front desk in writing prior to my visit that I decline.
8. Minors. Day Pass access is available to guests age 13 and older; children under 13 require prior arrangement. If signing on behalf of a minor, I represent that I am the minor's parent or legal guardian with authority to bind the minor, and I release all claims on the minor's behalf to the fullest extent permitted by law.
9. Indemnification. I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost (including reasonable attorneys' fees) arising from my presence at or use of the Facilities, whether caused by my negligence or otherwise.
10. Governing Law. This Agreement is governed by the laws of the U.S. Virgin Islands, and any dispute shall be resolved in the courts of St. Thomas, USVI.
11. Acknowledgment. I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS, INCLUDING MY RIGHT TO SUE. I AM SIGNING FREELY AND VOLUNTARILY AS A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.

Easy to Find, Hard to Leave
The Mary Anne is located in the Charlotte Amalie Historic District, right next to Blackbeard’s Castle and the famous 99 Steps. If you’re arriving from the cruise port, it’s a quick 5-minute taxi ride up the hill.
From the Cruise Port: Tell your taxi driver “Blackbeard’s Castle” or “Government Hill” ā they’ll know exactly where to go. The ride takes about 5 minutes and costs approximately $5ā7 per person.
Driving or taking a rideshare: We’re at the top of Government Hill in Charlotte Amalie. Parking is limited, so we recommend taxi or rideshare.

Lyndsey and her team were phenomenal. She was super helpful prior to booking to answer any questions we had about the stay. The washer and dryer were super convenient for us to get ready for our second cruise departing from St Thomas . They even had Nespresso machines and pods for guests! A lot of comfortable outdoor seating and the pool has amazing views. There is also a restaurant within walking distance, no need to go downtown if you arrive late and too tired to walk further or take a taxi. Our room was immaculate and the bed very comfortable. They even let us check out later than usual as they didn't have any other guesses for the next day . We took advantage of it to browse a bit downtown in the morning, which is very easy to access by the 99 steps close by, and we just had to get a taxi to go back (my elder husband could easily go down but going up would have been too hard on his knees). The staff was very helpful in ordering a taxi to our embarkation pier . Do I need a reservation?
Yes. Day passes are limited based on hotel guest occupancy and cannot be guaranteed as walk-ins. We recommend booking at least 24-48 hours in advance, especially during peak cruise ship days.
What are the hours?
Day pass access is from 10 AM to 5 PM.
How far is it from the cruise port?
About 5 minutes by taxi. Tell your driver “Blackbeard’s Castle” and they’ll bring you right to us. The ride costs approximately $5ā7 per person.
Can I bring kids?
Yes, children are welcome. Day pass pricing applies to guests ages 13 and up. Please contact us for details on younger children.
Is food available on-site?
We offer pre-order options including charcuterie boards, continental breakfast, poolside cocktails by the gallon, beer buckets, wine, and local hard seltzers. All food and beverage must be ordered in advance. There are also many restaurants within a short walk.
What should I bring?
Just yourself and a swimsuit. We provide towels, lounge seating, and Wi-Fi. Sunscreen is a good idea. We also offer a Beach Day Package ($60) that includes quick-dry towels, sunscreen, and beach essentials if you’re heading to the beach after.
Can I book a day pass and a wedding or event?
Absolutely. Many of our wedding and event guests add day passes for friends and family who aren’t staying at the hotel. It’s a great way to extend the celebration.
Is there a minimum group size?
No minimum. Day passes are available for solo visitors, couples, and groups. For parties of 8 or more, please contact us directly so we can ensure we have everything ready.
